Terms of Service

1. Applicable General Terms

The use of the KoiraKaveri app ("App") is subject to the standard end-user license agreement of the platform through which you downloaded the App:

• Apple devices: Apple Standard EULA
• Android devices: Google Play Terms of Service

By downloading and using the App, you agree to the applicable platform terms listed above.

The KoiraKaveri Custom Terms below supplement these platform terms. In the event of a conflict between these KoiraKaveri Custom Terms and the applicable platform terms, these KoiraKaveri Custom Terms will apply to the extent permitted by the platform.

2. KoiraKaveri Custom Terms

2.1. Eligibility and Age Requirements

You must be at least 16 years of age to create an account and use KoiraKaveri. If you are under 16, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these terms on your behalf.

By creating an account, you confirm that you meet the age requirement or have obtained the necessary parental or guardian consent.

2.2. Medical & AI Disclaimer

KoiraKaveri includes features that track your dog's health (e.g., poop quality tracking, health index) and an AI Assistant that provides guidance and summaries.

• Not a veterinary medical device or diagnosis: KoiraKaveri is intended for monitoring general well-being and daily life. The health reports, symptom assessments, or advice provided by the App's AI never replace the diagnosis or treatment provided by a qualified professional veterinarian.
• Emergencies: In acute medical or emergency situations, always contact a veterinarian immediately.
• Limitations of AI: The App's AI is based on a vast library of expert knowledge, but AI models can produce inaccurate or incorrect information. As a user, you understand and agree that decisions regarding your dog's care, medication, and training are always made at your own risk.

2.3. Sitter Mode and Shared Responsibility

In the KoiraKaveri Pro subscription, a user can invite external persons ("Dog Sitter") to their in-app family group to care for the dog temporarily.

• Owner's Responsibility: The account owner is fully responsible for whom they invite to their family group and what information (e.g., health journal, instructions) they share with the sitter.
• Temporary Access: Sitter Mode rights are temporary, and the owner can revoke access or end the care period at any time. KoiraKaveri is not responsible for the dog sitter's actions or events occurring outside the App during the care period.

2.4. User Obligations and Acceptable Use

By using KoiraKaveri, you agree to:

• Provide accurate and truthful information when creating your account and dog profiles.
• Not use the App for any unlawful purpose or in any way that could damage, disable, or impair the service.
• Not attempt to gain unauthorized access to any part of the App, other user accounts, or systems connected to the App.
• Not upload content that is illegal, harmful, threatening, abusive, or that infringes the rights of others.
• Not misrepresent your identity or impersonate another person.
• Keep your login credentials confidential and notify us immediately if you suspect unauthorized access to your account.

2.5. Subscriptions, Payments, and Feature Limitations

KoiraKaveri offers a free basic version (Free) as well as paid subscription options (Premium and Pro).

• Subscription Tiers: Different subscription tiers include different features, such as limits on the number of dogs or family group members, and the use of AI features (health reports, advanced training). Exact details of the packages are presented in the App at the time of purchase.
• Billing and Cancellations: All subscriptions, payments, and cancellations are securely processed through Apple's App Store or Google Play in accordance with their respective terms. Canceling a subscription is done through your device's subscription settings. We use third-party services to manage subscriptions across platforms; details on these services and how your data is handled are provided in our Privacy Policy.
• Free Trials: If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. The trial terms and pricing are presented in the App before you start the trial.
• Refunds: Refund requests are handled by the applicable app store (Apple App Store or Google Play) in accordance with their refund policies. KoiraKaveri does not process payments or refunds directly.
• Downgrade and Lapse: If your subscription lapses or you downgrade to a lower tier, you will retain access to your existing data, but features exclusive to higher tiers will become unavailable until you resubscribe. KoiraKaveri reserves the right to delete data associated with premium features after an extended period of inactivity (no less than 12 months), with prior notice sent to your registered email.

2.6. Intellectual Property

• KoiraKaveri's IP: The App, including its design, code, AI models, training content, illustrations, and branding, is the intellectual property of Eläinlähtöinen Oy or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the App.
• Your Content: You retain ownership of the content you upload to the App (such as photos, notes, and health journal entries). By uploading content, you grant KoiraKaveri a limited, non-exclusive license to store, process, and display that content solely for the purpose of providing and improving the service.
• AI-Generated Content: Content generated by the App's AI (such as health summaries and training suggestions) is provided for your personal use only. It may not be redistributed commercially without written permission from Eläinlähtöinen Oy.

2.7. Privacy and Data Processing

KoiraKaveri is designed with respect for your privacy.

• Data Location and Processing: We store your primary data (such as dog profiles, health journals, and chat history) on servers located within the European Economic Area (EEA). However, certain data — including your email address, subscription information, and data processed by AI features — may be stored or processed outside the EEA by our third-party service providers. Where data is transferred or stored outside the EEA, we ensure appropriate safeguards are in place in compliance with the GDPR. Full details on our subprocessors, their data locations, and applicable safeguards are provided in our Privacy Policy.
• User Content and Uploads: You are entirely responsible for the information, files, and images you choose to upload to the service. If you upload files or images containing Personally Identifiable Information (PII), you understand and agree that while this information is securely stored inside the EEA, it may be processed outside of the EEA by our service providers under the safeguards described in our Privacy Policy.
• AI Privacy and Summaries: Conversations with the AI Assistant are processed by machines to generate responses. KoiraKaveri employees do not routinely access your personal health or chat data, except where required by law, to investigate potential abuse, or to resolve critical technical issues. We do, however, create anonymized (irreversibly de-identified) summaries of the topics discussed with the AI to improve our content and app experience. Details on AI data processing and how to opt out are provided in our Privacy Policy.
• Your Rights: Under the GDPR, you have the right to access, correct, delete, and export your personal data. You also have the right to object to or restrict certain types of processing. For details on how to exercise these rights, please refer to our Privacy Policy.

2.8. Limitation of Liability

To the maximum extent permitted by applicable law:

• KoiraKaveri is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
• Eläinlähtöinen Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from reliance on AI-generated advice.
• Eläinlähtöinen Oy's total aggregate liability to you for any claims arising from or related to these terms or your use of the App shall not exceed the amount you have paid for your subscription in the 12 months preceding the claim.
• Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

2.9. Termination and Suspension

• By You: You may stop using the App and delete your account at any time through the App's settings or by contacting us.
• By KoiraKaveri: We reserve the right to suspend or terminate your account if you violate these terms, engage in abusive or harmful behavior, or if we are required to do so by law. Where possible, we will provide you with advance notice and an opportunity to remedy the violation before terminating your account.
• Effect of Termination: Upon termination, your right to use the App ceases immediately. We recommend exporting your data before deleting your account, as all personal data is permanently deleted upon account deletion, in accordance with our Privacy Policy.

2.10. Changes to These Terms

We may update these terms from time to time. When we make changes:

• We will notify you via the App or by email to your registered address at least 14 days before the changes take effect.
• If you continue using the App after the changes take effect, you are deemed to have accepted the updated terms.
• If you do not agree with the changes, you may cancel your subscription and stop using the App before the changes take effect.

3. Governing Law and Dispute Resolution

These terms are governed by and construed in accordance with the laws of Finland, without regard to its conflict of law principles.

Any disputes arising from or relating to these terms or the use of the App shall be resolved as follows:

• Negotiation first: The parties shall first attempt to resolve the dispute through good-faith negotiations.
• Consumer disputes: If you are a consumer, you have the right to submit the dispute to the Consumer Disputes Board of Finland (kuluttajariitalautakunta). Before doing so, we recommend contacting Consumer Advisory Services.
• Court jurisdiction: If the dispute cannot be resolved through the above channels, it shall be settled by the District Court of Helsinki, Finland.
